Actxa Terms of Use

1. ACCEPTANCE OF TERMS
By accessing or using Actxa websites, mobile applications, wearable devices, or related services (“Services”), you agree to be bound by these Terms of Use.
If you do not agree to these Terms, you must not access or use the Services.
2. ELIGIBILITY
You may use the Services only if:
• you are at least 13 years old
• you are legally capable of forming a binding contract
• you comply with applicable laws
If you are under the age of majority in your jurisdiction, you may use the Services only with parental or guardian consent.
3. SERVICES
The Services include:
• Actxa wearable devices
• mobile applications
• websites
• wellness analytics platforms
• AI-powered wellness technologies including BGEM®
Actxa may modify, suspend, or discontinue any part of the Services at any time without liability.
4. HEALTH AND MEDICAL DISCLAIMER
Actxa Services are intended solely for wellness and informational purposes.
They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease.
The Services do not provide medical advice. Users should consult qualified healthcare professionals for medical concerns.
5. AI AND ALGORITHMIC INSIGHTS
Some features of the Services use machine-learning technologies and automated processing.
Outputs generated by these technologies:
• are estimates
• may contain inaccuracies
• should not be relied upon for medical decisions
Actxa makes no guarantees regarding the accuracy or reliability of algorithmic outputs.
6. USER ACCOUNTS
Users are responsible for:
• maintaining the confidentiality of their account credentials
• ensuring the accuracy of information provided
• all activities conducted under their account
You must immediately notify Actxa of any unauthorized use of your account.
7. ACCEPTABLE USE
Users agree not to:
• reverse engineer, decompile, or disassemble any part of the Services
• scrape, extract, or harvest data from the Services
• interfere with or disrupt system security or functionality
• use the Services to develop competing products
• misuse or tamper with Actxa devices or firmware
8. INTELLECTUAL PROPERTY
All intellectual property rights in the Services, including software, algorithms, AI models, BGEM® technology, firmware, trademarks, and content, remain the exclusive property of Actxa or its licensors.
Users receive a limited, non-exclusive, non-transferable licence to use the Services for personal, non-commercial purposes.
9. USER DATA
You retain ownership of data that you submit or generate through the Services.
However, you grant Actxa a worldwide, royalty-free licence to process, store, analyse, and anonymise such data to operate, improve, and develop the Services.
10. THIRD-PARTY SERVICES
The Services may integrate with third-party platforms or services.
Actxa is not responsible for the availability, accuracy, or policies of third-party services.
11. WARRANTY DISCLAIMER
The Services are provided “as is” and “as available.”
Actxa disclaims all warranties including:
• accuracy of sensor measurements
• reliability of insights
• uninterrupted or error-free availability of services
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Actxa shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Services.
13. INDEMNIFICATION
You agree to indemnify and hold harmless Actxa and its affiliates from claims, damages, or liabilities arising from:
• misuse of the Services
• violation of these Terms
• infringement of third-party rights
14. TERMINATION
Actxa may suspend or terminate access to the Services if users violate these Terms or engage in activities that may harm the Services or other users.
15. GOVERNING LAW
These Terms of Use are governed by the laws of Singapore, without regard to conflict-of-law principles.
16. CHANGES TO TERMS
Actxa may update these Terms periodically. Updated versions will be posted on the Actxa website or application.
Continued use of the Services constitutes acceptance of the updated Terms.
